Terms of Use:

SIA VADNEG, registration number 40203591757, legal address Aronas Street 5, Madona, LV-4801, hereinafter referred to as the online store, provides content available on the website and offers goods/services in accordance with the Terms of Use outlined below.

1. General Terms

If a consumer purchases goods/services through the website, such an agreement is considered a Distance Contract and is subject to the laws of the Republic of Latvia governing distance contracts, including, but not limited to, the Consumer Rights Protection Law of the Republic of Latvia, the Cabinet of Ministers' Regulations on Distance Contracts, and others.

2. Making Purchases

The prices and specifications of the products sold in the online store are listed next to the products.

To place an order, add the desired products to the shopping cart. Fill in all the required fields and choose the most suitable delivery method. The total cost of the order, including delivery, will then be displayed on the screen. Proceed with payment to complete the order.

3. Payment Terms

The currency used for transactions on the website is the euro. Purchases can be paid using the following payment methods provided by the payment platform makecommerce.lv (Maksekeskus AS):

  • Online bank payments: Swedbank, SEB, Citadele, and Luminor
  • Visa/Mastercard card payments

NB! When using online bank payment, confirm the order and click the "Return to Merchant" button.

The personal data required for making payments is transferred to the licensed payment institution Maksekeskus AS.

The contract becomes valid upon successful payment into the online store's bank account. If, for any reason, the order cannot be fulfilled, the buyer will be informed, and the paid amount will be refunded as soon as possible, but no later than 14 days after receiving the notification.

4. Delivery Terms

Goods are delivered to the member states of the European Union. Purchased goods are delivered using parcel locker partners or courier services. All fees and taxes required to receive the shipment at the delivery destination must be covered by the buyer. Delivery costs are displayed before order confirmation. Purchased goods are delivered to the address provided by the buyer within 3–20 working days. In exceptional cases, we reserve the right to send goods within 45 calendar days, informing the customer about this.

5. Right of Withdrawal

The buyer has the right to withdraw from the purchase within 14 calendar days from the moment of receiving the goods. (Depending on the product, the buyer may not have the right to withdraw; in such cases, the reason must be clearly indicated and explained). The right of withdrawal does not apply if the buyer is a legal entity.

To use the 14-day right of withdrawal, the product may only be used for its intended purpose, and the consumer is responsible for maintaining the quality and safety of the product during the withdrawal period. If the product is misused or damaged, carelessly handled, or if the original packaging is lost or significantly damaged, the online store has the right to reduce the refundable amount according to the product's depreciation.

To exercise the right of withdrawal, you must submit the withdrawal form, which can be found here: https://negrulux.lv/index.php?route=account/return/add, by sending it to the email address negrulux.shop@gmail.com within 14 days of receiving the goods. The buyer covers the cost of returning the product, except in cases where the product does not match the order (e.g., incorrect or defective product).

The buyer must return the product to the seller without delay, but no later than 14 days after submitting the withdrawal form to the online store. Upon receiving the returned product, the online store will immediately, but no later than within 14 days, refund all payments received from the buyer based on the Distance Contract.

The seller has the right to withhold payment until the product is received from the buyer or proof of return is provided. If the buyer chooses a delivery method other than the cheapest available option offered by the online store, the online store is not obliged to refund the additional delivery costs.

The online store is not liable for delays or non-performance of obligations or any other failure to perform due to circumstances and obstacles beyond the online store's reasonable control.

The online store reserves the right to refuse to sell goods and request the return of goods from the buyer if the price listed in the online store is significantly lower than the market price due to an error.

When placing an order with a bank link, a commission fee is charged according to the Maksekeskus AS price list. This fee will not be refunded in case of product returns or order cancellations.

6. Consumer Rights Regarding Non-conforming Products

The online store is responsible for any non-conformity of the goods sold to the buyer or defects that occur within 6 months from the date of delivery to the customer or were present at the time of delivery unless this assumption is contrary to the nature of the goods or defect. The buyer must notify the seller of the non-conformity immediately, within 2 months of discovering it, by submitting a complaint. The buyer can submit a complaint by contacting the online store via email negrulux.shop@gmail.com.

The online store is not responsible for defects that occur after the goods have been delivered to the buyer. If the purchased goods have defects for which the seller is responsible, the buyer has the right to request the repair of the goods or exchange them for new goods free of charge.

If the goods cannot be repaired or replaced, the seller will refund all payments made under the Distance Contract to the buyer. The seller will provide a written response to the consumer's complaint within 15 days.

7. Processing of Buyer’s Personal Data

The online store processes only the personal data provided by the buyer during the ordering process, such as name, surname, email, etc.

The online store transfers personal data to the delivery service provider(s) to ensure the delivery of the goods.

If you have explicitly agreed to receive our marketing communications, including newsletters, we may occasionally contact you with information about our services and latest offers. For this purpose, we may process the email address you provided when signing up for marketing communications. The buyer can opt out of marketing communications by notifying us via negrulux.shop@gmail.com.

8. Dispute Resolution Procedure

In matters not covered by these terms and conditions, the buyer and the seller agree to comply with the laws in force in the Republic of Latvia.

The parties shall resolve any disputes between the seller and the buyer through mutual negotiations or correspondence. If the dispute cannot be resolved through negotiations or correspondence, the parties will resolve the dispute in the courts of the Republic of Latvia, in accordance with Latvian law. Disputes between the buyer (consumer) and the seller can be submitted for resolution to the Consumer Rights Protection Centre or the courts of the Republic of Latvia.

The buyer also has the right to turn to European Union dispute resolution bodies.
